The standard forms under Council Directives 92/50/EEC, 93/36/EEC, 93/37/EEC and 93/38/EEC are regulated by Commission Directive 2001/78/EC of 13 September 2001 amending Annex IV to Council Directive 93/36/EEC, Annexes IV, V and VI to Council Directive 93/37/EEC, Annexes III and IV to Council Directive 92/50/EEC, as amended by Directive 97/52/EC, and Annexes XII to XV, XVII and XVIII to Council Directive 93/38/EEC, as amended by Directive 98/4/EC (Directive on the use of standard forms in the publication of public contract notices) (OJ L 285, 29.10.2001 p. 1-162). These standard forms are applied by Member States until the entry into force of the national measures transposing the new Directives 2004/17/EC and 2004/18/EC and at longest until 31 January 2006.

In addition to instruments dealing exclusively with public procurement, this section contains agreements of a more general nature which contain binding provisions on public procurement.

Europe Agreements establishing associations are currently in force with respectively Bulgaria and Romania and contain provisions on public procurement. However they will be terminated when these countries accede to the European Union: 21994A1231(20) Europe Agreement establishing an association between the European Economic Communities and their Member States, of the one part, and Romania, of the other part (OJ L 357, 31.12.1994 p. 2-189); 21994A1231(24) Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Bulgaria, of the other part (OJ L 358, 31.12.1994 p. 3-222).

Directive 2004/18 replaces, as of 31 January 2006, Council Directive 92/50 of 18 June 1992 relating to the coordination of procedures for the award of public service contracts; Directive 93/36/EEC of 14 June 1993 coordinating procedures for the award of public supply contracts and Directive 93/37/EEC of 14 June 1993 concerning the coordination of procedures for the award of public contracts, as modified by European Parliament and Council Directive 97/52/EC of 13 October 1997 amending Directives 92/50/EEC, 93/36/EEC and 93/37/EEC concerning the coordination of procedures for the award of public service contracts, public supply contracts and public works contracts respectively.

The current values of the thresholds under Council Directives 92/50/EEC, 93/36/EEC, 93/37/EEC and 93/38/EEC were established by the Commission Communication – Values of thresholds under the directives on public procurement applicable from January 2004 (OJ C 309, 19.12.2003 p. 14-15).

Directive 2004/17 replaces, as of 31 January 2006, Council Directive 93/38/EEC of 14 June 1993 coordinating the procurement procedures of entities operating in the water, energy, transport and telecommunications sectors, as modified by Directive 98/4/EC of the European Parliament and of the Council of 16 February 1998.
